According to Aether & Flux's title page, spells, domains, magic items, character classes, skills, feats, character and creature attributes and game mechanics wholly derived from the d20 SRD are Open Game Content, and everything else is the Product Identifty owned solely by Dark Furies Publishing. So the book certainly couldn't go up. However, oddly enough, it sounds like Aether Sails and their related equipment, being magic items could go up, but Flux Sails and *their* equipment being other stuff, couldn't. Odd. Anyway, since this is a product still available for sale, it would have been unkind to place it up, even if legal.
